New TCPA Rules Effective October 16, 2013
Federal telemarketing and lead generation rules affect the way you can communicate with potential customers. Speak2Leads promises a safe, user-friendly, and compliant Lead Response solution. We are committed to keeping our clients informed and educated on the best method to obtain the necessary consent to call.
Lead Response S2L
The Federal Communications Commission (FCC) makes it generally illegal to deliver a prerecorded message to a consumer or business phone (cell & landline) or use an "automatic telephone dialing system" to call any cell phone unless you obtain prior written consent. Individuals who add themselves to the national Do-Not-Call (DNC) list are protected from prerecorded or auto-dialed calls.
When connecting with new leads, our system is intentionally incapable of making illegal auto dialed or prerecorded calls. Lead Response S2L only auto dials your company and sales team, who then manually "press 2" to connect with leads. The manual dialing process requires human intervention, which is compliant and immediate in the way we connect you with leads (on cell or landlines) without the use of restricted technology.
In short, the Lead Response S2L service is compliant with new regulations. You do not need to ask for any additional consent in order to use the Lead Response S2L service.
Lead Revival S2L
When communicating with past clients, existing business relationships, or prospects, the FCC makes it illegal to deliver a prerecorded message or use any form of automated dialing to call a cell phone unless you obtain prior written consent. Speak2Leads can help you determine the best method to obtain the necessary consent to call.
It is still compliant to send prerecorded messages to business landlines without consent. Therefore, when using Lead Revival S2L to reach out to prospects in your old database (without consent), your database needs to be scrubbed against a list of all cell phone numbers. We can scrub the data and provide you with a revised list that does not include cell phone numbers to ensure that you remain compliant with cell phone rules.
It is also necessary to utilize certain disclosures and opt-out procedures. The message you send must inform the call recipient with the following:
1. Who you are and why you are calling
2. Your real telephone number
3. How to avoid future calls through an automated opt out process (interactive voice or key-press)
Once again, individuals who add themselves to the national DNC list are protected from prerecorded or auto dialed calls. Read about the DNC list at DoNotCallLaw.com.
Please be aware that state telemarketing rules vary widely. Some states require licensing and bonding for companies that use any form of telemarketing. You can read about these rules and requirements at TelemarketingCompliance.com, TelemarketingLicenses.com, and TelemarketingBonds.com
Violations of telemarketing law carry significant penalties, which you can read about at TelemarketingFines.com
